Application: A system or software developed using the WebWidgets.io Platform and API. Applications are designed to provide specific benefits or services to Users, utilizing the Core and, optionally, Extended Features of the Platform.
User: Any end-user of an Application running on the WebWidgets.io Platform. Users interact with Applications for various purposes, including but not limited to accessing services, information, or functionalities provided through the Platform.
Developer: An individual or entity that develops Applications using the WebWidgets.io Platform. Developers utilize the provided tools, APIs, and features to create and manage Applications for Users.

These definitions are intended to ensure a clear understanding of the terms and their usage within these Terms of Service and the overall provision of the WebWidgets.io service.

Developer Responsibilities

As a Developer utilizing the WebWidgets.io Platform, you play a crucial role in creating a safe, secure, and trustworthy environment for all Users. Failure to comply with these responsibilities may result in the suspension or termination of your access to the Platform and its services.

This includes, but is not limited to, applications involved in fraud, phishing, harassment, abuse, spamming, copyright infringement, distribution of malware, and exploitation of any kind.
Data Privacy and Security: Developers are responsible for ensuring that their Applications comply with all applicable data protection laws and regulations. This includes securing user data against unauthorized access, breaches, and ensuring user privacy is respected and protected.
Respect Intellectual Property: Developers must ensure that their Applications do not infringe on the intellectual property rights of others. Compliance with Laws: Developers are required to ensure that their Applications and their use of the WebWidgets.io Platform comply with all local, state, national, and international laws and regulations.

WebWidgets.io reserves the right to review and monitor Applications for compliance and to take appropriate action, including removal of content or suspension of access, in cases of violation.

Content Ownership and Intellectual Property

Developer Intellectual Property: Developers retain all rights, title, and interest in and to the applications they create on the WebWidgets.io Platform, including any source code, graphics, images, and text incorporated into their applications. WebWidgets.io does not claim any ownership rights over applications developed on the Platform.
Data Ownership: Developers own all data contained within their applications' databases. This includes user-generated content, application data, and operational data. Developers have the full right to download, upload, modify, and delete their data in accordance with their needs and at their discretion, subject to compliance with applicable laws and regulations.
Third-Party Content: If a developer's application includes third-party content, it is the responsibility of the developer to secure any necessary rights or permissions to use and display that content within their application.

Account Cancellation

Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in New Hampshire, before one arbitrator. The arbitration shall be administered by JAMS, pursuant to its Arbitration Rules & Procedures.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (1) no arbitration or proceeding shall be joined with any other; (2) there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures; and (3) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Arbitration: As permitted by law, you may have the right to bring claims in a small claims court of competent jurisdiction.
